PivotPoint Live Virtual (Online) Coaching Subscriptions are non-refundable, and it is essential to schedule and utilize all Virtual Coaching Sessions within the designated timeframe for your chosen subscription, typically 6 or 12 month subscription periods. The subscription start date begins on the first work day of the week when your initial Virtual Coaching Session is scheduled. Any Virtual Coaching Sessions that remain unscheduled and unused within the specified time limits for the corresponding subscription will be forfeited, with no refund eligibility for the subscriber client.
To ensure a wider variety of available dates and times for your Virtual Coaching Sessions, it is advisable to schedule them as early as possible. We generally recommend scheduling Virtual Coaching Sessions in a consistent Agile rhythm or cadence (e.g., weekly, bi-weekly, tri-weekly, quad-weekly) that accommodates both your Agile MBSE team and your Agile MBSE Expert Coach.
Virtual Coaching Sessions must be scheduled at least 14 days prior to the desired Session date/time, during mutually agreeable dates and times.
Both parties can cancel (terminate for convenience) or reschedule Virtual Coaching Sessions by providing a written notice at least fourteen (14) days in advance. If the Client cancels with less than fourteen (14) days of advance written notice, the value of the concerned Virtual Coaching Session will be forfeited, and no refund will be given.
This policy aims to balance customer needs in exceptional circumstances with a sustainable business approach.
PivotPoint Technology Corp. ("PivotPoint") hereby asserts its exclusive rights to all copyrighted training materials provided to the Client as part of its Training Services. The Client agrees not to copy, distribute, modify, or create any derivative works from these materials without prior written permission from PivotPoint.
Furthermore, the Client is prohibited from recording or digitally streaming PivotPoint's live instruction content in any form, including video, audio, and images, without prior written permission from PivotPoint.
Any unauthorized use of PivotPoint's training materials may violate copyright laws and will be subject to legal action. By entering into a training agreement with PivotPoint, the Client agrees to respect the intellectual property rights of PivotPoint and to use the training materials only as explicitly permitted by this Copyright Notice.
Whenever a Client wants to use confidential information for Training, Consulting, or Technical Support purposes, PivotPoint will be glad to execute a mutual Non-Disclosure Agreement (NDA) that protects the confidential information of both Parties in a fair and balanced manner. As a general policy, PivotPoint will only execute mutual NDAs, instead of unilateral NDAs, since the latter agreements tend to be one-sided and fail to adequately protect PivotPoint's Intellectual Property and vital business information (such as that typically required for vendor registration). As a PivotPoint Client you can provide your own mutual NDA for us to consider; alternatively, we will be glad to provide you with a PivotPoint mutual NDA.
All PivotPoint onsite training, consulting, and tech support services are subject to cancellation or re-scheduling due to severe weather or other unforeseen emergency situations. In the event of severe weather or other unforeseen emergency situations, contact us for further information about cancellation or re-scheduling.
With the exception of services subject to a legally binding contract, PivotPoint reserves the right to change prices and Terms & Conditions for its services at any time without notice.
